The data controller shall inform the data subject electronically, in accordance with Article 19 of the GDPR, of the erasure of any personal data provided by the data subject. Categories of data subjects<\/h3>\n<ul>\n<li>data subjects who have registered on the social media site and \u2018liked\u2019 the Data Controller\u2019s profile page,<\/li>\n<li>data subjects who contact the Data Controller via private message on the social media site.<\/li>\n<\/ul>\n<h3>2. Purpose of data processing<\/h3>\n<ul>\n<li>The purpose of data processing is to share and promote the Data Controller\u2019s activities and services on the Facebook social media platform. The Data Controller may use the data provided by the data subject in a private message to reply to that message; otherwise, the Data Controller does not collect data via social media platforms, nor does it extract data from them.<\/li>\n<\/ul>\n<h3>3. Legal basis for data processing<\/h3>\n<ul>\n<li>Data processing is based on Article 6(1)(a) of the GDPR; the legal basis for data processing is the data subject\u2019s consent to the processing of their personal data on the Facebook social media platform.<\/li>\n<\/ul>\n<h3>4. Scope of data processed<\/h3>\n<ul>\n<li>the data subject\u2019s registered name,<\/li>\n<li>the data subject\u2019s public profile picture<\/li>\n<li>other public data provided or shared by the data subject on the social media site<\/li>\n<\/ul>\n<p><strong>5. Source of the personal data processed:<\/strong> The source of the data processed is the data subject.<\/p>\n<p>6. Withdrawal of consent: You may withdraw your consent to data processing at any time and delete your posts and comments. Data processing takes place via social media sites, which are operated by a third party. Should you withdraw your consent, the Data Controller will delete the conversation held with you. Withdrawal of consent does not affect the lawfulness of data processing carried out on the basis of that consent prior to the withdrawal.<\/p>\n<p>Data subjects may request access to their personal data, the erasure or rectification of such data, or the restriction of its processing, as well as data portability, in the following ways:<\/p>\n<ul>\n<li>by post to 7630 P\u00e9cs, Iparsziget u. 3, Hungary<\/li>\n<li>by email to pom@pomorgona.com,<\/li>\n<li>by telephone on +36 72 239 603.<\/li>\n<\/ul>\n<h3>7. Duration of data processing<\/h3>\n<ul>\n<li>until the data subject withdraws their consent,<\/li>\n<li>or, where correspondence takes place, for 2 years.<\/li>\n<\/ul>\n<p><strong>8. Transfer of personal data, recipients and categories of recipients: <\/strong>For the definition of \u2018recipient\u2019, see Article 4(9) of the GDPR. The Data Controller shall only disclose the Data Subject\u2019s personal data to state bodies and authorities \u2013 in particular courts, the public prosecutor\u2019s office, investigative authorities and administrative offence authorities, and the National Authority for Data Protection and Freedom of Information \u2013 in exceptional cases and where required by law.<\/p>\n<h2>9. Possible consequences of failure to provide data<\/h2>\n<p>If data is not provided, the data subject will not be able to find out about the Data Controller\u2019s activities and services via the Facebook social media platform, or send messages to the Data Controller via Facebook Messenger.<\/p>\n<p><strong>10. Automated decision-making (including profiling):<\/strong> No automated decision-making, including profiling, takes place during data processing.<\/p>\n<h3>11. Joint data controller agreement with Facebook Ireland Ltd.:<\/h3>\n<p>The Page Insights feature displays aggregated data which provides an overview of how data subjects use the Facebook page. Facebook Ireland Limited (\u201cFacebook Ireland\u201d) and the Data Controller are joint controllers with regard to the processing of analytics data. The Page Insights Addendum sets out Facebook\u2019s responsibilities and the Data Controller\u2019s responsibilities in relation to the processing of analytics data. Facebook Ireland assumes primary responsibility under the GDPR for the processing of analytics data and undertakes to comply with all relevant obligations set out in the GDPR in relation to the processing of analytics data. Facebook Ireland shall also make an extract of the Page Insights Addendum available to all data subjects. The Data Controller shall ensure that it has a lawful basis under the GDPR for the processing of analytics data, identifies the Page\u2019s data controller, and complies with all other relevant legal obligations. Facebook Ireland is solely responsible for the processing of personal data in connection with the Page Insights feature, with the exception of data falling within the scope of the Page Insights Addendum. The Page Insights Addendum does not grant the Data Controller the right to request the personal data of Facebook users processed by Facebook Ireland in connection with Facebook, including page analytics data. The Data Controller may not act on behalf of Facebook Ireland or provide a response when fulfilling data protection requests.<\/p>\n<h2>Customer relations and other data processing activities<\/h2>\n<ol>\n<li>Should any questions arise whilst using the data controller\u2019s services, or should the data subject encounter any problems, they may contact the data controller via the methods specified on the website (telephone, email, social media, etc.).<\/li>\n<li>The data controller will delete emails, messages and data provided by telephone, on Meta, etc., together with the enquirer\u2019s name and email address, as well as any other personal data provided voluntarily, no later than two years after the data was provided.<\/li>\n<li>We will provide information regarding any data processing operations not listed in this notice at the time the data is collected.<\/li>\n<li>In the event of an exceptional request from a public authority, or a request from other bodies authorised by law, the Service Provider is obliged to provide information, disclose or transfer data, or make documents available.<\/li>\n<li>In such cases, the Service Provider shall disclose personal data to the requesting party \u2013 provided that the latter has specified the exact purpose and scope of the data \u2013 only to the extent strictly necessary to fulfil the purpose of the request.<\/li>\n<\/ol>\n<h2>The rights of data subjects<\/h2>\n<h3>1. The right of access<\/h3>\n<p>You have the right to receive confirmation from the data controller as to whether your personal data are being processed, and, where such processing is taking place, you have the right to access your personal data and the information set out in the Regulation.<\/p>\n<h3>2. The right to rectification<\/h3>\n<p>You have the right to have inaccurate personal data concerning you rectified by the data controller without undue delay upon your request. Taking into account the purposes of the data processing, you have the right to request that incomplete personal data be completed, including, amongst other things, by means of a supplementary statement.<\/p>\n<h3>3. The right to delete<\/h3>\n<p>You have the right to request that the data controller erases your personal data without undue delay, and the data controller is obliged to erase your personal data without undue delay under certain conditions.<\/p>\n<h3>4. The right to be forgotten<\/h3>\n<p>Where the data controller has made the personal data public and is obliged to erase it, it shall, taking into account the available technology and the cost of implementation, take all reasonable steps \u2013 including technical measures \u2013 to inform controllers processing the data that you have requested the deletion of links to, or copies or replicas of, the personal data in question.<\/p>\n<h3>5. The right to restrict processing<\/h3>\n<p>You have the right to request that the data controller restrict the processing of your data if any of the following conditions are met:<\/p>\n<ul>\n<li>You contest the accuracy of the personal data; in this case, the restriction applies for the period necessary to enable the data controller to verify the accuracy of the personal data;<\/li>\n<li>the processing is unlawful, and you object to the erasure of the data and instead request that its use be restricted;<\/li>\n<li>the data controller no longer needs the personal data for the purposes of data processing, but you require it for the purpose of establishing, exercising or defending legal claims;<\/li>\n<li>You have objected to the processing of your data; in this case, the restriction applies for as long as it has not been established whether the data controller\u2019s legitimate grounds take precedence over your legitimate grounds.<\/li>\n<\/ul>\n<h3>6. The right to data portability<\/h3>\n<p>You have the right to receive the personal data concerning you, which you have provided to a data controller, in a structured, commonly used and machine-readable format, and you are also entitled to transmit those data to another data controller without hindrance from the data controller to whom you have provided the personal data (&#8230;)<\/p>\n<h3>7. The right to protest<\/h3>\n<p>In the case of data processing based on legitimate interests or the exercise of official authority as legal grounds, you have the right to object at any time, on grounds relating to your particular situation, to the processing of your personal data by (&#8230;), including profiling based on the aforementioned provisions.<\/p>\n<h3>8. Objection in the case of direct canvassing<\/h3>\n<p>Where personal data is processed for the purposes of direct marketing, you have the right to object at any time to the processing of your personal data for this purpose, including profiling, insofar as it relates to direct marketing. If you object to the processing of your personal data for the purposes of direct marketing, your personal data may no longer be processed for that purpose.<\/p>\n<h3>9. Automated decision-making in individual cases, including profiling<\/h3>\n<p>You have the right not to be subject to a decision based solely on automated processing \u2013 including profiling \u2013 which produces legal effects concerning you or similarly significantly affects you.<\/p>\n<p>The previous paragraph shall not apply where the decision:<\/p>\n<ul>\n<li>it is necessary for the conclusion or performance of a contract between you and the data controller;<\/li>\n<li>it is authorised by Union or Member State law applicable to the data controller, which also lays down appropriate measures to safeguard your rights, freedoms and legitimate interests; or<\/li>\n<li>it is based on your explicit consent.<\/li>\n<\/ul>\n<h2>Deadline for taking action<\/h2>\n<p>The data controller will inform you of the action taken in response to the above requests without undue delay, but in any event within one month of receiving the request.<\/p>\n<p>If necessary, this may be <strong>extended by 2 months<\/strong>. The data controller will inform you of any extension to the deadline, stating the reasons for the delay, <strong>within 1 month<\/strong> of receiving your request.<\/p>\n<p>If the data controller does not take action in response to your request, <strong>it shall inform you without delay, but no later than one month from receipt of the request, of the reasons for not taking action<\/strong>, and of your right to lodge a complaint with a supervisory authority and to seek a judicial remedy.<\/p>\n<h2>Data protection<\/h2>\n<ol>\n<li>The data controller and the data processor shall take into account the state of the art and the costs of implementation, as well as the nature, scope, context and purposes of the processing, and the risk of varying likelihood and severity to the rights and freedoms of natural persons, in order to ensure a level of data security appropriate to the risk, including, where applicable:<\/li>\n<li>the pseudonymisation and encryption of personal data;<\/li>\n<li>ensuring the ongoing confidentiality, integrity, availability and resilience of the systems and services used for the processing of personal data;<\/li>\n<li>in the event of a physical or technical incident, the ability to restore access to personal data and the availability of such data in a timely manner;<\/li>\n<li>a procedure for the regular testing, assessment and evaluation of the effectiveness of the technical and organisational measures taken to ensure the security of data processing.<\/li>\n<li>Processed data must be stored in such a way that unauthorised persons cannot access it. In the case of paper-based data carriers, this is achieved by establishing procedures for physical storage and archiving; in the case of data processed in electronic form, by using a central access control system.<\/li>\n<li>he method of storing data using IT systems must be chosen in such a way that the data can be deleted \u2013 taking into account any differing retention periods \u2013 upon expiry of the data retention period, or whenever necessary for other reasons. The deletion must be irreversible.<\/li>\n<li>Personal data must be removed from paper-based data carriers using a document shredder or by engaging an external organisation specialising in document destruction. In the case of electronic data carriers, physical destruction must be carried out in accordance with the rules governing the disposal of electronic data carriers, and, where necessary, the data must first be securely and irreversibly erased.<\/li>\n<li>The data controller takes the following specific data security measures:<\/li>\n<\/ol>\n<p>To ensure the security of personal data processed in paper form, the Service Provider applies the following measures (<em>physical protection<\/em>):<\/p>\n<ol>\n<li>Documents must be stored in a secure, lockable, dry room.<\/li>\n<li>Where personal data held in paper form is digitised, the rules governing digitally stored documents must be applied<\/li>\n<li>Any member of the Service Provider\u2019s staff involved in data processing may only leave the room where data processing is taking place whilst on duty if they secure the data storage media entrusted to them or lock the room in question.<\/li>\n<li>Personal data may only be accessed by authorised persons; third parties must not have access to it.<\/li>\n<li>The Service Provider\u2019s building and premises are equipped with fire safety and security systems.<\/li>\n<\/ol>\n<p>IT security<\/p>\n<ol>\n<li>The computers and mobile devices (and other data storage media) used in the course of data processing are the property of the Service Provider.<\/li>\n<li>The computer system used by the Service Provider that contains personal data is equipped with virus protection.<\/li>\n<li>To ensure the security of digitally stored data, the Service Provider carries out data backups and archiving.<\/li>\n<li>Access to the central server is restricted to authorised personnel only.<\/li>\n<li>Data stored on the computers can only be accessed using a username and password.<\/li>\n<\/ol>\n<h2>Informing the data subject about the data breach<\/h2>\n<p>Where a data breach is likely to result in a high risk to the rights and freedoms of natural persons, the data controller shall inform the data subject without undue delay.<\/p>\n<p>The information provided to the data subject must describe <strong>clearly and in plain language<\/strong> the nature of the data breach and must include the name and contact details of the data protection officer or any other contact person providing further information; it must describe the likely consequences of the data breach; it must describe the measures taken or planned by the data controller to remedy the data breach, including, where appropriate, measures to mitigate any adverse consequences arising from the data breach.<\/p>\n<p>The data subject need not be informed if any of the following conditions are met:<\/p>\n<ul>\n<li>the data controller <strong>has implemented appropriate technical and organisational security measures<\/strong>, and these measures were applied to the data affected by the data breach, in particular those measures \u2013 such as the use of encryption \u2013 which render the data <strong>unreadable to persons not authorised to access the personal data;<\/strong><\/li>\n<li>the data controller has, following the data breach, taken further measures which <strong>ensure that the high risk to the data subject\u2019s rights and freedoms is unlikely to materialise in the future<\/strong>;<\/li>\n<li>providing the information <strong>would require a disproportionate effort<\/strong>. In such cases, data subjects must be informed through publicly available information, or similar measures must be taken to ensure that data subjects are informed in an equally effective manner.<\/li>\n<\/ul>\n<p>If the data controller has not yet notified the data subject of the data breach, the supervisory authority may, after assessing whether the data breach is likely to result in a high risk, order that the data subject be notified.<\/p>\n<h2>Reporting a data breach to the supervisory authority<\/h2>\n<p>The data controller shall, without undue delay and, where possible, no later than 72 hours after becoming aware of the data breach, to the supervisory authority competent under Article 55, unless the data breach is unlikely to pose a risk to the rights and freedoms of natural persons.
